Building permit for land development - what is it?

A building permit is a document that defines the requirements for the placement and construction of an individual residential, garden or summer house no higher than two floors (excluding the attic) with an area of up to 500 square meters and outbuildings and structures, garages, elements of landscaping and landscaping of the land plot.

Cases when you need to issue a Construction Passport

If you own a land plot and have decided to build on the plot, for example, a residential building, you need to take a number of steps to legally begin construction work.

Procedure for submitting a notice of commencement of construction work

According to the provisions of the current Legislation of Ukraine, for the construction of buildings and structures that belong to objects with the impact class of SS1, before starting construction, it is necessary to:

• obtain a document called the “Construction passport for the development of a land plot”;

• after that, submit a notice of commencement of construction work through the Construction Activity Portal;

• then the Construction Customer can carry out the construction of the object on legal grounds.

Note

Most cottages and land development projects of individuals are classified as projects with a CC1 impact class (projects with minor liability consequences).

 

In the case of the construction of an individual residential, garden or summer house no higher than two floors (excluding the attic) with an area of up to 500 square meters and outbuildings and structures, garages, elements of landscaping and landscaping of the land plot, the Construction Passport for the development of the land plot is drawn up.

 

But in some cases, before starting construction, it is necessary to obtain another type of document - Town Planning Conditions and Land Plot Restrictions. Therefore, when preparing a package of documentation for the planned construction, it is advisable to consult with the design organization or the authorized Urban Planning and Architecture Authority of the local government body on the territory of which construction is planned.

Procedure for issuing a Building Passport

The Building Passport is issued by the authorized Urban Planning and Architecture Authority (in most cases, this is the Department of Architecture of the local community or the local district State Administration).

The package of documents for obtaining a building passport is submitted by the Construction Customer (or its representative on the basis of the Power of Attorney) through the Centers for the Provision of Administrative Services, or through the "Diya" portal, or by filling out an application for receiving the service online on the website: 

Documents that must be submitted to obtain a Building Passport:

• application for the issuance of a Building Passport;

• a certified copy of a document confirming the right of ownership or use of a land plot, or a Superficie Agreement;

• a copy of the title deed for the real estate object located on the land plot (in case of intentions to reconstruct or overhaul an existing real estate object);

• consent of the co-owner of the real estate object to carry out reconstruction or overhaul (in case of a co-owner of the object);

• a scheme of intentions for the development of the land plot (location of buildings and structures on the land plot, distances to the borders of neighboring land plots and objects located on them, engineering networks and structures, facades and floor plans of objects with an indication of overall dimensions, a list of engineering support systems);

• a construction project (if available);

• consent of the co-owner of the land plot to develop the land plot (if there is a co-owner of the plot);

• information about the presence of regime-forming cultural heritage objects within the land plot and restrictions on the use of the land plot in the event of a new construction of the object (if any).
