Urban planning conditions and restrictions are a document that contains a set of planning and architectural requirements for design and construction and is one of the components of the initial data for design.
Cases when it is necessary to draw up Urban Planning Conditions and Restrictions on the Development of a Land Plot
If you own or use a land plot and have made a decision to build a construction site with a class of consequences of SS1 (objects with minor consequences of liability) on the site - in order to legally begin construction work, you need to take a number of preliminary actions, including:
• obtain a document called "Construction Passport" or "Urban Planning Conditions and Restrictions on the Development of a Land Plot" (depending on the specific object of the planned construction);
• after that, submit a notification of the start of construction work through the Construction Activity Portal;
• then the Construction Customer can carry out the construction of the object on legal grounds;
• at the same time, the parameters of your construction site must comply with the main indicators and requirements specified in the “Construction Passport” or “Urban Planning Conditions and Restrictions on Land Development” you received
Most cottages and land development sites of individuals, as well as buildings and structures built by small enterprises, farms, etc. - are classified as objects with a CC1 impact class (objects with minor liability consequences).
According to the provisions of the current legislation of Ukraine, for the construction of buildings and structures that belong to objects with a CC1 impact class, before the start of construction, it is necessary to obtain a document called the “Construction Passport for Land Development”.
But very often, when issuing Building Passports, local urban planning and architecture authorities emphasize that for some construction projects (for example, if the customers are legal entities; or for certain types of land plots intended for development; and in some other cases) it is impossible to issue a Building Passport, but it is necessary to issue Urban Planning Conditions and Land Development Restrictions.
In such cases, if they are truly justified by the requirements of the current legislation of Ukraine, it is necessary to submit a package of documents to the relevant authorities to obtain Urban Planning Conditions and Land Development Restrictions.
The issuance of Urban Planning Conditions and Land Development Restrictions is carried out by the authorized Urban Planning and Architecture Authority (in most cases, this is the Department of Architecture of the local community or the local district State Administration).
The submission of a package of documents to obtain Urban Planning Conditions and Development Restrictions for a Land Plot is carried out by the Construction Customer (or its representative on the basis of the Assignment) through the Administrative Services Centers, or through the "Diya" portal, or by filling out an application for receiving the service online on the website:

• certified copy of a document certifying the right of ownership or use of a land plot, or a Superficie Agreement;
• copy of a document certifying the right of ownership of a real estate object located on the land plot, or the consent of its owner (co-owners - if any) in the event of reconstruction or restoration;
• situational plan (scheme) of the location of the land plot (in any form);
• copy of the topographic and geodetic plan M 1:2000;
• town planning calculation that determines the Customer's investment intentions with technical and economic indicators of the planned construction object (in any form).
